§ 6-5. Compliance with construction code and fire code.
(a)
All bars shall be constructed and maintained in conformity with the construction code and the fire code, except as otherwise provided in subsection (b) of this section.
(b)
A bar that is situated in any building located in an area heretofore or hereafter annexed to the city and was originally constructed in compliance with the laws applicable in the area prior to its annexation may be operated even though the floor space therein exceeds the maximum area specified in the building code, provided the bar meets all of the otherwise applicable standards and requirements specified in the construction code that relate to stairs, exits, and occupant loads and all applicable provisions of the fire code.
(c)
For the purpose of the enforcement of this section, any inspector designated by the city council shall be deemed a deputy of the fire marshal and any of the powers and duties herein given to the fire marshal may be exercised by any such inspector on behalf of the fire marshal.
