§ 6-7. Location of alcoholic beverage sales restricted.

  • (a)

    It shall be unlawful to sell or offer for sale any alcoholic beverage from a place of business which is located within 300 feet of any church, public school or public hospital.

    (b)

    It shall be unlawful for a bar, cabaret, or nightclub to be located within 1,000 feet of any church, public or private school, or public hospital.

    (c)

    For the purpose of this section, the measurement of the distance between the place of business where alcoholic beverages are sold and the church, public school, or public hospital shall be along the property lines of the street fronts and from front door to front door, and in a direct line across intersections.

    (d)

    It shall be a defense to prosecution under this chapter if the place of business selling alcoholic beverages, bar, cabaret, or nightclub was lawfully located in a particular location prior to the location of any church, public school, or public hospital within any distance prohibited by this section.
